The band Lynyrd Skynyrd was formed under the name Lynyrd Skynyrd in Jacksonville, Florida in 1969. Lynyrd Skynyrd soon reached global popularity behind landmark hits such as Tuesday’s Gone, Simple Man, Sweet Home Alabama, and Free Bird, bringing the so- called “Southern Rock” genre of music to global prominence. Lynyrd Skynyrd’s popularity and fame continues to grow, with over twenty-eight million records sold in the United States alone. 
Lynyrd Skynyrd has earned numerous accolades for its music, including induction into the Rock and Roll Hall of Fame in 2006 and inclusion in Rolling Stone’s “100 Greatest Artists of All Time.” Products sold under the Lynyrd Skynyrd brand include apparel, accessories, and other merchandise, such as guitar picks.
Lynyrd Skynyrd branded products are distributed and sold to consumers throughout the United States, including in Illinois, through various affiliates, and through the lynyrdskynyrd.com website and lynyrdskynyrdshop.com webstore.

Plaintiff incorporates a variety of distinctive marks in the design of its various Lynyrd Skynyrd products. As a result of its long-standing use, Plaintiff owns common law trademark rights in its trademarks. Plaintiff has also registered its trademarks with the United States Patent and Trademark Office. Lynyrd Skynyrd products often include at least one of Plaintiff’s registered trademarks. 
Plaintiff uses its trademarks in connection with the marketing of the Lynyrd Skynyrd products, including the following marks which are collectively referred to as the “LYNYRD SKYNYRD Trademarks.”
