Plaintiff is the exclusive licensee for Avenged Sevenfold branded merchandise in the United States.
Avenged Sevenfold is an American heavy metal band formed in 1999, currently comprised of Matthew Sanders (also known as M. Shadows), Brian Haner (also known as Synyster Gates), Zachary Baker, Jonathan Seward (also known as Johnny Christ), and Brooks Wackerman. The band’s debut album, Sounding the Seventh Trumpet, originally released in 2001 and subsequently re-released in 2002. As of 2010, Sounding the Seventh Trumpet has sold 370,000 copies worldwide, with 310,000 sold in the United States. Since the band’s debut, Avenged Sevenfold has released eight studio albums, one soundtrack album, one live album, two compilation albums, twenty-four singles, two video albums, and twenty-nine music videos.
