Bane has been involved in purchasing art since 1988. Initially, his approach to sourcing artwork involved meticulously searching sites like DeviantArt for artists whose work aligned with his tastes. He would then contact artists open for commissions, forming the foundation of his collection. Plaintiff also purchases the copyright rights to previously created images. However, infringement of his artwork began soon after the opening of “The Dreaming Dragon,” and has been an ongoing issue. Despite his efforts in tracking down infringing products, the platforms are slow to remove them and often his takedown requests are often unsuccessful. The mass infringement has greatly impacted his sales and is causing him to stop buying art and growing his business
