Brand Introduction:
Plaintiff Intersport Corp. d/b/a WHAM-O is a California corporation and acts as the sales, marketing, design, and distribution arm of WHAM-O products in the Americas, with a place of business at 966 Sandhill Avenue, Carson, California 90746. Plaintiff WHAM-O HOLDING, LTD. is a foreign company organized and existing under the laws of Hong Kong.
WHAM-O is, and at all relevant times has been, engaged in the business of manufacturing, marketing, promoting, selling, and distributing bodyboards under the BOOGIE brand and trademarks. The BOOGIE BOARD Trademarks are famous, distinctive, and sourceidentifying marks that symbolize WHAM-O’s goodwill and reputation. Since at least 1971, WHAM-O has continuously used the BOOGIE BOARD Trademarks in commerce in connection with bodyboards, and WHAM-O’s BOOGIE BOARD Trademarks have come to identify and distinguish WHAM-O’s goods from those of others. WHAM-O has sold millions of products under the BOOGIE BOARD Trademarks, and products sold under the BOOGIE BOARD Trademarks have achieved substantial commercial success and widespread recognition among consumers. Through extensive sales, advertising, promotion, and use, WHAM-O has created strong consumer association between the BOOGIE BOARD Trademarks and WHAM-O as the sole source of goods sold thereunder.
